Terms of Service

1. Agreement & Platform Acceptance

By accessing, integrating, or creating an account on the DistroPay platform, you agree to comply with and be legally bound by these Terms of Service, all applicable regulations under the Information Technology Act 2000 (India), and the regulatory guidelines issued by the Reserve Bank of India (RBI).

2. API License & Fair Usage Policy

DistroPay grants registered merchants a non-exclusive, non-transferable, revocable license to access our APIs solely to process legitimate payment transactions. Under this license you agree NOT to:

  • Use the payment gateway for prohibited activities, money laundering (PMLA violation), betting/gambling, or illegal goods/services under Indian law.
  • Circumvent API rate limits, automated UTR verification safeguards, or security protocols.
  • Decompile, reverse-engineer, or attempt to extract underlying platform source code or database structures.
  • Share, leak, or expose your private secret keys (`sk_live_...`) to unauthorized third parties.

3. Direct Bank Settlements & Non-Escrow Model

DistroPay provides technical API routing infrastructure. All payment flows settle directly into your merchant bank accounts or linked UPI VPAs (0% MDR fee). Because transaction funds do not route through DistroPay escrow accounts:

  • DistroPay is not responsible for bank network delays, NPCI downtime, or individual bank server maintenance.
  • Merchants maintain sole responsibility for fulfilling orders and resolving customer refund or chargeback disputes.

4. Platform Uptime & SLA

While we target 99.9% high-availability uptime across our global routing infrastructure, DistroPay services are provided on an "as is" and "as available" basis. We continuously monitor third-party node availability (HDFC, PhonePe, Paytm) and automatically cascade transactions via Smart Route Cascading.

5. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, claim, or proceeding arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
